This City Cloud Terms and Conditions provided for you (“the Customer”) in connection with the City Cloud service that Customer has purchased (the “Service”). These terms and conditions comprise the entire agreement between Customer and City Cloud with respect to the Service(s) City Cloud provides.
MODIFICATIONS TO TERMS AND CONDITIONS
City Cloud may change the terms and conditions of the Service(s) from time to time. Upon any such change, City Cloud will notify the Customer by posting the changes to www.CityCloud.ca, where the Service was purchased. City Cloud reserves the right to modify or discontinue the Service with or without notice to the Customer. City Cloud exercises its right to modify or discontinue the Service. Customer’s use of the Service constitutes an affirmative agreement by the Customer to abide and be bound by these Terms and Conditions and its modifications.
City Cloud takes security measures to preserve and protect the Customer’s privacy and will view their files only when necessary to perform City Cloud’s services.
Unless stated in writing, all fees and charges are non-refundable. City Cloud may change the fees and charges that are in effect or add new fees or charges, only by giving the Customer notice in advance.
City Cloud’s rates and prices are posted on the website, www.CityCloud.ca. City Cloud’s fee for diagnosis is $20 but it will be waived if the Customer authorizes the repair. Should the price need to be revised, City Cloud will notify the Customer before making the repair. If the Customer requests particular Merchandise (parts) but City Cloud does not have it in store, City Cloud will purchase it for the Customer at the Customer’s cost before the purchase is made. The merchandise will be purchased without warranty. HST will be added to all prices and fees.
*ALL MERCHANDISE IS NON-REFUNDABLE. MERCHANDISE BEING EXCHANGED FOR DEFECTIVENESS MUST BE IN LIKE-NEW CONDITION WITH ORIGINAL RECIEPT WITHIN 30 DAYS OF PURCHASE*
THERE IS A $10.00 FEE FOR TRAVEL TIME (also non-refundable)
BACKING UP DATA
The Customer understands that City Cloud does not backup their computer’s files including data, music, and documents prior to providing any services except the “Data Backup” service. City Cloud is not responsible for the loss of any data while performing the data backup recovery service. City Cloud will back up the Customer’s data if it is included in the purchased package. (CITY CLOUD DOES NOT BACK UP SOFTWARE THAT IS INSTALLED PRIOR TO THE CITY CLOUD’S SERVICE).
DATA LOSS AND RECOVERY
City Cloud will make every effort to maintain the integrity of the Customer’s computer files. However, City Cloud is not responsible for any loss of data that may occur. The Customer acknowledges that City Cloud’s data recovery attempt may not succeed however; there will still be a 10% charge of the original price of agreement.
City Cloud is liable for the damage to the Customer’s computer that is caused by City Cloud’s negligent acts. Software upgrades and removal of viruses and other malware may damage software and/or data that is installed on the Customer’s computer and may require the re-installation of the Customer’s operating system, programs and data at NO COST. City Cloud is not responsible for any type of loose hardware or harm done to the Customer’s data and programs during the performance of the Services to the Customer’s computer. The Customer is responsible for backing up their files prior to any services the customer receives from City Cloud.
City Cloud offers an “Overnight-Warranty” this warranty is only offered if a computer is in the possession of City Cloud over night. The Over-Night warranty is a security that the Customer is guaranteed (only when purchased) their computer be returned to the Customer as accepted and/or after serviced. If the Customer’s computer gets lost, damaged or stolen while in the possession of City Cloud, the Over-Night warranty will promise the Customer a replacement computer with only the programs installed that City Cloud is able to provide. * Over-Night warranty is $10.00 per night*
All services are covered by our 30 day warranty. If the same problem re-occurs within 30 days of the original repair (stated on the invoice), City Cloud repair service will only charge for any additional parts that may be required. Excludes faults caused by software, virus and end user errors. Additional warranty is available starting at $10.00 a month.
CITY CLOUD MEMBERSHIP PLAN
By completing the registration process, City Cloud members are subject to following plan levels: City Cloud level I, City Cloud level II and City Cloud level III. (See plans for details)
This service does not include hardware repair or replacement.
If your membership expires you cannot have your computer repaired for free, at this point you must pay the full fee for the repair.
If your membership is still valid your computer can be repaired as many times as stated in the package purchased. Customer support hours vary depending on the purchased package. See plans for details.
NOTICE - IN STORE USE ONLY: Customers must have the original receipt when bringing the computer in for repair as proof of warranty. If there is no receipt, there will be a regular charge for the computer to be repaired. The Customer must provide a receipt from PayPal if membership was purchased online.
MEMBERSHIP PLAN WARRANTY
The warranty purchased is only valid with the computer it was purchased for. For example, if a warranty is purchased for an Acer Aspire one computer, that warranty is only valid for that Acer Aspire one computer, it will not be accepted for repairing any other computer.
MEMBERSHIP REFUND POLICY
When a member chooses to terminate their membership, they must do so in writing to refund@CityCloud.ca citing the reason for the termination of their membership to be considered for a refund. Please note that if a refund is issued, City Cloud will retain $5.00 from the membership fee for the levels I & II plan, and $10.00 the level III plan. City Cloud will retain these amounts as an administrative fee.
REMOTE SUPPORT SECURITY
City Cloud respects the privacy of the Customer and will never call the Customer to request their ID and/or password. This information must be entered in the website by the Customer or the Customer can call City Cloud and speak to a City Cloud representative and provide the information, when that is done the City Cloud representative will take care of the rest.
*NOTE: ONCE THE REMOTE SERVICE SESSION IS COMPLETED, THE PASSWORD IS AUTOMATICALLY CHANGED. THEREFOR, CITY CLOUD HAS NO ACCESS TO THE CUSTOMER’S COMPUTER AFTER THE SERVICE IS COMPLETE.*
WEBSITE RENTAL AND HOSTING
City Cloud has taken all reasonable steps to ensure the security of the City Cloud website and subscriber personal information. However, City Cloud cannot be held liable for unauthorised third party security breaches of the site or any unauthorised usage of subscriber personal information.
The information provided on this site is supplied in good faith and is intended as a guide to assist you when making decisions about advertising. While all care is taken to provide accurate and up to date information we recommend you also consult your City Cloud representative for more detailed information.

Please note that all subscribers are annually billed through Paypal. If you wish to unsubscribe you must unsubscribe 30 days before payment is due to avoid getting billed. If you do not unsubscribe before the due date arrives, Paypal will automatically begin your bill for the following year. Once Paypal creates a bill for the following year, there will then be no refunds.
WHAT IS ALLOWED ON CITY CLOUD
Subscribers of City Cloud are allowed to post their ads on CityCloud.ca
Subscribers are allowed to add up to five keywords per ad; all keywords MUST target their business ONLY.
Subscribers are allowed to update or edit their ad at anytime
Subscribers are allowed to change their keywords as many times necessary
Subscribers are allowed to put a pause to their ads as many times necessary and for as long as needed
Subscribers are allowed to add more than one ad under their domain as long as a package to support it is purchased.
WHAT IS NOT ALLOWED ON CITY CLOUD
Subscribers are not allowed to post any pornographic ads on CityCloud.ca
Subscribers are not allowed to post any biased ads on CityCloud.ca, e.g. hate ads, racism ads etc
Subscribers are not allowed to use keyword spam. If your ad is aimed towards flowers, your keywords should only be geared towards flowers and nothing else. Example: Ad: flowers - keywords: flowers, garden etc
All accounts must have a valid email address
Every subscriber must follow the terms and conditions of this website.
There are absolutely NO refunds once the ad is activated.
If you wish to cancel your payment, you must cancel your subscription by logging into your Paypal account and cancelling it.
